DEFENSE TRADE SOLUTIONS
CLASSIFICATION

Perhaps the best place to start for any potential defense exporter is to determine under which United States Munitions List (USML, 22 CFR Part 121) category your export is controlled. 

COMMODITY JURISDICTION

"The purpose of a commodity jurisdiction (CJ) request is to determine whether an item or service is covered by the U.S. Munitions List (USML) and therefore subject to export controls administered by the U.S. Department of State pursuant to the Arms Export Control Act and the International Traffic in Arms Regulations (ITAR)." 

REGISTRATION

"All manufacturers, exporters, and brokers of defense articles, related technical data and defense services as defined in the United States Munitions List (Part 121 of the ITAR), are required to register with the Directorate of Defense Trade Controls (DDTC)" of the Department of State (DoS).

  • Provide regulatory expertise in the application of US export and import regulations as controls are updated.

  • Provide continuous incremental training to the empowered official and designated employees.

  • Provide a regulatory perspective on the appropriate jurisdiction and classification of products and services.

  • Manage the submission and status of designated license and agreement applications through final adjudication.

  • Maintain liaison with the appropriate agencies for designated licenses, agreements and compliance issues.

  • Provide a regulatory perspective on the interpretation of provisos and related requests.

AUTHORIZATIONS

"Generally, any person or company who intends to export or to temporarily import a defense article, defense service, or technical data must obtain prior approval from DDTC. The appropriate license form must be submitted for the purpose of seeking approval."
